1 ACCEPTANCE OF TERMS
Your access to and use of the website is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

2 ORDER ACCEPTANCE
All orders are final and subject to the conditions in this document. The customer accepts these when placing an order. All images should be securely saved by the customer beyond the time of placing the order. Personalised Postcards do not save or keep the data transmitted by the customer after print and delete all order related digital data with order fulfilment. All postcards are digitally colour printed and finished to A6 size using 330 gsm single-side coated graphical board and laminated for superior image quality and protection.

The customer is not allowed to upload any images other than photographic in content or other material which contain:

- nudity or pornographic or obscene or sexually inciting material;

- racist or extremist material;

- material that is likely to incite hatred against any person or group;

- blasphemous material;

- defamatory or otherwise actionable material;

- images of any criminal act;

- material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party;

- material that breaches any applicable laws or legislation.

Any uploaded images deemed to include such material by Personalised Postcards, its suppliers or partners, shall be deleted or destroyed after print and no refund given to the customer.

3 PROPERTY RIGHTS
The customer herewith confirms, that he is responsible for the content of images transmitted and entitled to transmit and print the images. The customer agrees when placing orders that he will only use the services of Personalised Postcards and its partners in a manner that is consistent with these Terms and Conditions and in a way that complies with all applicable laws and regulations. The customer will defend and hold harmless Personalised Postcards, its partners, officers, directors, employees, agents, licensors, suppliers and any third party and providers to Personalised Postcards from and against any or all losses, expenses, damages and costs including legal fees resulting from any violation of the Terms and Conditions, or any activity relating to the customers account by the customer or any other person that uses the services through the customer’s account.

4 DELIVERY
Personalised Postcards strive to print and post orders received with validated payment from either PayPal or Google Checkout the following working day by Royal Mail First Class, but are under no obligation to do so. If an order becomes lost in the postal system, we will resend the order once 15 working days has passed since we posted the postcard/s, for which we may request the customer to resubmit the order data. Should the second order posted also become lost Personalised Postcards’ liability ceases. If Personalised Postcards have sent the customer’s order again and either postcard is returned to us for non collection from a sorting office or incorrect/incomplete address provided then the cost of this order is payable again.

5 ADVICE
The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

6 CHANGES TO WEBSITE
Personalised Postcards reserves the right to:
6.1 change or remove (temporarily or permanently) the Website or any part of it, including the price, without notice and you confirm that Personalised Postcards shall not be liable to you for any such change or removal; and
6.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

7 LINKS TO THIRD PARTY WEBSITES
The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

8 COPYRIGHT
8.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Personalised Postcards or otherwise used by Personalised Postcards as permitted by law.
8.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

9 DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
9.2 To the extent permitted by law, Personalised Postcards will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
9.3 Personalised Postcards makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
9.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Personalised Postcards for death or personal injury as a result of the negligence of Personalised Postcards or that of its employees or agents.
9.5 In no event shall Personalised Postcards or its suppliers’ or its partners maximum liability, under any circumstances whether based on action or claims in contract or in tort (including without limitation negligence and strict liability) exceed the purchase price of the postcard order.

10 SEVERANCE
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

11 GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
